Buyer Terms & Conditions & Liability Disclaimer

By purchasing, subscribing to, accessing, or using the Sunshine Check-In System, the Buyer (“Buyer”, “Subscriber”, “Business Owner”) agrees to the following Terms & Conditions. If you do not agree, you must not purchase or use the system.


1. Service Description

Sunshine Check-In System is a digital customer check-in and loyalty tracking tool for small businesses. The system is provided “as-is” and is not a financial, legal, or guaranteed data-backup service.


2. Assumption of Risk

Buyer understands and accepts that:

  • Technology may fail

  • Devices may be lost, stolen, damaged, or reset

  • Internet or third-party services may be interrupted

Buyer assumes all risks related to the use of the Sunshine Check-In System.


3. Subscription & Fees

  • Subscription fee: $50 per month (unless otherwise agreed in writing)

  • Taxes will be charged as required by applicable state and local laws.

  • Subscription fees are non-refundable

  • Fees are billed in advance

  • Non-payment may result in suspension or permanent deactivation


4. Suspension, Locking & Deactivation Rights

Sunshine Check-In reserves the right to suspend, lock, or permanently disable the system without liability if:

  • Subscription payment is overdue

  • System misuse or abuse is detected

  • Fraud or illegal activity is suspected


5. Ownership of Equipment 

  • Any iPad, kiosk, stand, accessories, or related hardware provided by Sunshine Check-In remain the sole property of Sunshine Check-In System at all times.

  • Buyer is only purchasing a subscription service, not ownership of hardware & software.

  • Buyer has no ownership rights over any Sunshine Check-In equipment including software.


6. Device Responsibility

Buyer is fully responsible for:

  • Safe use and care of the iPad, kiosk, and accessories

  • Physical security of the equipment

  • Damage, theft, loss, or unauthorized access

  • Any changes made by Buyer or Buyer’s staff

Sunshine Check-In is not responsible for:

  • Theft or loss

  • Screen or hardware damage

  • Water, power, or environmental damage

  • Battery failure

  • Staff misuse or negligence


7. iCloud & Data Disclaimer

  • Customer check-in data may sync using Apple iCloud or other third-party services.

  • Sunshine Check-In does not control Apple iCloud, Apple ID, or Apple services.

  • Data availability depends on device settings, Apple services, and internet connection.

Sunshine Check-In is not responsible for:

  • Data loss or corruption

  • iCloud sync failure

  • Apple ID issues

  • Accidental deletion

  • Device reset or replacement

  • Theft, destruction, or device crash

Buyer understands that data protection ultimately depends on the Buyer’s device management.


8. No Data Guarantee

Sunshine Check-In makes no guarantee that:

  • Data will always be available

  • Data will never be lost

  • Backups will always succeed

Buyer is encouraged to maintain independent records or backups if required.


9. Customer Data & Privacy Responsibility

  • Buyer is responsible for informing customers about check-in usage

  • Buyer must comply with all applicable privacy and consumer protection laws

  • Sunshine Check-In does not sell customer data

  • Sunshine Check-In is not responsible for Buyer’s handling or misuse of customer data


10. Loyalty Rewards Responsibility

Buyer solely controls:

  • Reward rules

  • Discount values

  • Redemption policies

Sunshine Check-In is not responsible for:

  • Customer dissatisfaction

  • Financial losses due to promotions

  • Miscommunication between Buyer and customers


11. No Guarantee of Results

Sunshine Check-In does not guarantee:

  • Increased sales

  • Increased customers

  • Increased profit or retention

Business results depend entirely on Buyer’s management and customer engagement.


12. Limitation of Liability

To the maximum extent permitted by law:

  • Sunshine Check-In shall not be liable for indirect, incidental, or consequential damages

  • Maximum liability, if any, shall never exceed one (1) month subscription fee paid


13. Indemnification

Buyer agrees to indemnify and hold harmless Sunshine Check-In from any claims, damages, losses, or legal costs arising from Buyer’s use of the system.


14. Cancellation Policy

  • Buyer may cancel the subscription at any time by phone call, email, or text message

  • Cancellation must be requested before the next billing cycle to avoid future charges

  • No refunds for partial months or past payments


15. No Legal Claims / Limited Legal Action

By using the Sunshine Check-In System, the Buyer agrees that they will not bring any lawsuit, court case, or legal claim against:

  • Sunshine Check-In System

  • Its owners, employees, partners, contractors, or affiliates

for ordinary disputes, including but not limited to:

  • Data loss or missing data

  • Device theft, damage, or malfunction

  • System downtime or interruption

  • Business loss or reduced revenue

  • Customer disputes or complaints

  • Software errors or third-party service failures

If any dispute arises, the Buyer agrees to:

  • First attempt good-faith resolution directly with Sunshine Check-In

  • Waive the right to class-action lawsuits

  • Limit any claim strictly to the amount paid in the most recent one (1) month subscription, to the maximum extent permitted by law

This clause applies except where prohibited by law.


16. Equipment Return After Cancellation

  • After cancellation, Buyer has no right to keep, restrict, sell, or withhold the Sunshine Check-In iPad, kiosk, or accessories.

  • If Sunshine Check-In requires the return of equipment, Sunshine Check-In will issue a return shipping label.

  • Buyer must return all equipment within the timeframe provided and in reasonable condition (normal wear and tear accepted).

  • Failure to return equipment may result in additional charges or collection action.


17. Changes to Terms

Sunshine Check-In may modify these Terms at any time. Continued use of the system means acceptance of updated Terms.


18. Governing Law

These Terms & Conditions are governed by the laws of the State of New York, USA.
